Fee shifting statues are laws that allow a consumer’s legal fees paid by a business that wrongs the consumer. Fee-shifting is only available under certain circumstances, but when it is available, it is a powerful tool allowing for legal representation, often without cost to the client, in cases vindicating important rights. Typically, if a fee-shifting statue applies, a lawyer will represent the client and only require a small or no payment from the client; the lawyer will either be paid when the case is successfully resolved, or will go without fees if the case is unsuccessful.
